Pagdi shop, my father tenant
My father being tenant since 1999 in a pagdi shop. The landlord ishwar expired in 1988, Poonam who was landlord in 1999 at the time of purchasing tenancy rights. But asha (ishwar's sister ) asked for her share and included as waris in 1993. Poonam expired in 2012 (his son have not applied for Death certificate since his son is in America)
Asha son have won legal case and they have being declared waris in 2019,
Now we wanted to sublet the property but new landlord( asha's son) not allowing us. When we went into agreement with 3rd party (person who purchased tenancy right frm us) the new landlord (asha son) came and put lock on our shop with out court order.
When we complain to police they say go and fight in civil court. My dad are not well to do to afford court fees.
Our question:-
1.How can new landlord take possesion without court notice?
2. We have not got eviction notice, can we break the lock and take the possession back?
3. If we get eviction notice can we get compensation from new landlord?
4. We have not paid rent since there was civil court dispute going on between Poonam and asha since 2001, so we didn't know who was the actual owner. Plus we never received any notice from anyone to make the payment.
