Request for Legal Guidance Regarding Notice Period Payment and Relieving Letter Issuance
I hope this message finds you well. I am writing to seek your expert legal guidance regarding a situation I encountered during my employment with Company A. Here is a brief overview of my situation:
I joined Company A on June 17th, 2019, and my offer letter stipulated that I needed to serve a 2-year employment term or pay a penalty of 2 lakh rupees as per a bond agreement. However, upon reviewing the bond agreement, it was explicitly mentioned that the 2-year bond period commences after the completion of 1 year of training, essentially making it a 3-year commitment.
Subsequently, I left Company A on May 28th, 2021, without serving the notice period. Now, the company is requesting a payment of 1,55,000 rupees to issue a relieving letter.
Considering the circumstances, I would like to inquire about the following:
Is it possible to pay only the notice period amount and obtain a relieving letter without being subjected to the entire bond penalty?
What legal steps or negotiations can be taken to ensure a fair resolution in this matter?
Are there any potential legal implications or consequences I should be aware of when dealing with this situation?
Your professional advice and guidance on how to approach this matter would be greatly appreciated. Thank you for your time and assistance.
