Validity of an application fro reinstatement to the previous post due to service lien
Sirs,
I was serving as Lecturer in Govt Hr Sec Schools. I applied technical resignation to join another service under the same authority. My technical resignation was accepted with lien of two yrs (on 22nd June 2017). After about 2 and half yrs, my new service was terminated due to Honble High Court’s order(18th Oct 2019). Then I applied for reinstatement to my previous post after 2 and 6 months ( on 11th Dec 2019)of my technical resignation. However, the authority reinstated me on 22nd April 2021. As per rules of Technical resignation, the service lien shall be valid for two yrs and one more year in exceptional cases. My case is recommended to be treated as exceptional case. However, the problem is that the reinstatement was ordered after three yrs though I applied within the prescribed time. Therefore, my question is should I be allowed to enjoy all the benefits that an employee can enjoy after reinstated to previous post due to technical resignation? If yes, Please avail me the relevant rule)s).
