POCSO - Can an association be sued for lapse in security leading to misconduct with minor girl child
This incident happened last evening. A boy around the age of 12-15 (part of a group of honey collectors) walked into our apartment and rang the bell at our house. My 9 year old daughter opened the door. He spoke in Hindi and she didn't understand what he said. He gestured for her to follow her and she did. He took her to a isolated stairs portion and did vulgur gestures and only touched her hip. We realisee that she was not in the house immediately and called out to her and she came running and informed us about what happened.
We raised an alarm immediately and looked for him everywhere.
They security did not show any effort in this. A couple of my daughter's friends found him and informed an adult. The committee members then just spoke to him and let him go and informed us that he was caught and released without informing the police authorities.
My question is can the committee let him go just because he is a juvenile. They should have called the police to atleast see what had to be done or waited for us to call the cops. If this boy is doing this in a protected society, imagine the evil he is doing in his surrounding where girls have no protection.
I want to know if I can send a notice to the committee for lack of security that led to this incident so that they are warned. They are being arrogant and asking us not to over react. How can a parent bringing up a serious issue be over reaction?
They later called us and showed us the footage of the boy entering while the security was busy with something else.
They are asking us to file a FIR when they didn't even collect information about the boy or his whereabouts.
What can we do now to teach everyone a lesson so that this does not happen again and the committee sees the mistake they did.
