Clarification of judgement
Brief: I am a university staff in Chennai. Due to fabricated case I was removed from service. The removal was quashed by labour court awarded reinstatement, continuous of service and other benefits. It was given on January 2001. The university preferred interim stay. That was vacated during the year Sep 2011. The High court mentioned that I do not disturb the findings of the labour court except back wages and allow for Terminal/Pensionary benefit. My queries are:
1. The university given pensionery benefit for the period rendered service period 1.8.1983 to June 30, 1993. i.e for 10 years. My superannuation date was April 2009. Final judgement of high court was Sep.2011. in favour of me.
In my calculation service period is Aug.1983 (date of appointment) to date of superannuation i.e. April 2009. Approx.27 years, whereas university calculated the service period ( 1.8.1983 to 31.7.1993 total 10 years service, they treated the suspension period upto the date of superannuation as loss of pay. Whereas labour court ordered for continuity of service and other benefits. The labour court mentioned the action of the university as perverse. They have given mimimum pension and gratiuity for 10 years. Shall I get the continuity of service for 27 years for pension calculation? Shall I eligible to get promotion, increment, Vth and VI th pay commission revision of pay for pension calculation. Thus shall I ask for revised pension.
