Company pushed me to Resign before my 1 year agreement
Hi,
I joined a company on September 12th,2022. I signed an agreement stating that I will have to pay a compensation of 1,60,000 INR if I leave before one year.
Notice period that I need to serve is 3 months.
I sent my resignation letter on 28th August, 2023, I expressed my willingness serve my notice period and relieve from my position on 28th November 2023.
Considering the above, I would have completed my 12-month obligation even before the end of my notice period. It was the company who asked me to leave on 31st August,2023 without serving the notice period.
Now, the company is withholding my experience letter, relieving letter and my salary for the month August, 2023. Also, demanding me to pay a compensation of INR 1,60,000/- .
1. Is it legally right after asking the employee to leave before one year and demanding for the compensation?
2. Do I have to pay to get my experience and relieving letter?
3. Can I take legal action for not letting me work in my notice period because in the agreement they have mentioned that even if the company fires me they will have to give me three months notice period?
