Export of Vehicle
Dear All, we have Bought a truck and made a custom-made machinery for Export Purposes on Purchase Oder of a Buyer. The Carrier truck came with Temporary Registration, the time machine got ready, the Temporary Registration got expire. Now, The Forward Agent from Mumbai, is asking to get a NOC from RTA office to export the vehicle.
We assume that we need to Register the Vehicle and Cancel the Registration. And, also, since this is for export purposes, we need not to pay Life Tax.
RTA Officer in Hyderabad seems not familiar with this kind of facility, so they are confused. I have searched the Vehicle Act and found that under MV Act 1988 Section 55 Clause 4 States "If a registering authority is satisfied that a motor vehicle has been permanently removed out of India, the registering authority shall cancel the registration."
But this seems controversial as we need to cancel the registration before the export as we need NOC for Export Process at Customs. And as per the Act it says the motor vehicle has been permanently removed out.
So, need your opinion on this. Kindly let me know the correct procedure.
