Employer is forcing to come to office
Hello, I work in IT company in Bangalore. I joined in September 2022. Recently I have been not doing well and so I decided that I to resign. (I have IBS, severe Seborrhoea Dermatitis and a month back I was bradycardia). For few months I didn't have any work as well, so I asked my company to relieve me earlier. I resigned almost a month back and still they aren't properly giving relieving date (they sent a mail with odd clause saying if they want they will increase the relieving date). I asked if I can pay the amount for that also they aren't agreeing. (they are not accepting medical reasons or lieu). For entire month since resignation I have been asked to come to office and sit without work. Whenever I would ask me them on text or go to them to get clarification they would say come back tomorrow. I am currently so weak I can't even stand properly, I already 2 black outs in last week. I have no work, no client projects at this point dated 7 July from day of resignation, no dependencies as well.
This is clause for agreement
"The Company may terminate your employment with or without issuing a notice or without assigning any reason. Further, you may terminate your employment by issuing a notice of 60 working days or paying 60 working days salary in lieu of the notice to the Company. You agree and acknowledge that the notice period you are required to serve are essential to ensure the continuity of the Company's business and to
ensure suitable replacements are made with respect to the same. Decision will be taken by the management regarding relieving. Notwithstanding anything stated above, if you are in the middle of a project at the date of your resignation, in spite of the notice as above, you shall not be relieved from the company unless you have trained a replacement for the project to the satisfaction of the client."
