Retention Request on Medical Ground
My name is V. Shankar. I am working in Hindustan Petroleum Corporation Limited since last 33 years (joined in November 1990). I have a transferrable job and am presently posted in Rajkot, Gujarat for the past 10 years (since 2013). I have been suffering from Parkinson’s disease since 2011 and it was one of the reasons for my transfer to a desk job in Rajkot. Before Rajkot posting, I have been in field job. In Rajkot itself, I have been transferred thrice in different departments. Over the years, my health condition has been deteriorating. I require assistance for my daily tasks.
In the transfer list which was released on February 25, 2023, I was transferred to Chennai on a field posting. I have sent multiple emails, along with medical reports stating my condition to my Senior Officers, including Executive Director – Retail and Executive Director – HR, requesting for retention in Rajkot on medical ground. On not receiving any reply, I also went to Mumbai to personally meet the Executive Director – HR to plead my case. I have to use cabin wheelchair in flight, as I cannot walk more than a few steps. Also, I have only 2 years of service left (DOB 05 May 1965). I was informed telephonically today (28 April, 2023, which is the last date for joining the new posting), that my request for retention in Rajkot has been rejected, however, I have not received any written communication in this regard.
My health condition does not permit me to relocate. In the meanwhile, I am trying to apply for Unique Disability ID.
1. Should I apply for a stay order on my transfer from the Court? If so, how to proceed?
2. Am I eligible to present my case before the Central Administrative Tribunal?
Kindly advise me on the best course of action.
