Parking issue
Hi Sir,
I have purchased flat in the year 2009, in gram panchayat area and builder and landlord owners divided half flats equally out of total 15 flats. allotted 9 parking slots in the cellar at the time of purchase however there was no parking plan or approval copy given by builder for parking slots. now after 13 years , neighbouring flat was resold to new customer in 2022 and he claims the drive way next to my parking area as his parking as he also has parking of 100 sft in his sale registration where the first owner purchased it in 2008, like other 9 flats. so he also went to court and filed a case to get his parking and we also counter file. but recently he got injunction order which is yet to verify whats in it and details on what basis need to check as its still under CA process. So my question is how can court without verifying physically can provide interim order and what are the other options do I have? I am in process of getting signatures from all 9 parking slots owners and approached builder and he says I have sold 13 years back and not concerned any more, and does not sign NOC or Affidavit which says he has allotted only 9 parkings. Sent regsitered post complaining about builder and landlord owner to 4 PS that they are not responding to solve the issue so planning to proceed cheating case on builder. Also there is another flat owner who says even he has registered parking of 100 sft in his papers who brought in 2012. AS they also have another flat from 2009 so they are aware and not claiming this parking as its drive way. If driveway is blocked I will not be able to remove my car . Please advise on all options available further on this case which can be done from my end.
