Section 376 - False promise of marriage
The guy presented himself to me as a widower with one young daughter in 2018. But turns out his wife never died & he is a father of 3 daughters - I discovered this in March 2023 and got my 0 FIR done in April 2023 under sections 376 & 377 under false promise to marry. Due to an unfortunate surge in false cases of 376, police & courts have become very strict now - something I faced while getting 0 FIR done (I was judged & what not, even though I was ready to show my evidences).
My case & evidences are absolutely true. But the accused is super cunning and won't be easy to convict. Pls ans these practical questions:
1) Will he even get arrested just on the basis of my complaint? I'm ready to show my evidences (call recordings) and my own family members & friends as witnesses but the IO must AGREE to see the evidences instead of already dismissing my case or forming judgments.
2) The guy will deny all my allegations and make up fake stories just as he kept befooling me & my family for 5 long years. If he cooperates in investigation or bribes the police, will police arrest him?
3) My evidences are mostly electronic (call recordings). Should I get a forensic lab certification from a private/govt. lab for those audio call recordings to make my case stronger in front of the IO & court?
4) Can the police (IO) ask me to submit my device? If yes, should I submit? All my recordings are authentic BUT I fear damage of the evidence before my case reaches the trial. The accused & the police belong to the same city whereas my residence is in a different state. I fear the accused may use his power to impact the case & police. Can I request the IO to take a copy of the recordings & not the original files?
6) The recordings, if heard 'sincerely' by IO, will make things crystal clear - THAT MY ALLEGATIONS ARE TRUE. But in courts, do they actually work?
7) What grounds should I present to the honorable supreme court to transfer the trial to my state? Are such petitions practically successful?
8) Sorry to ask so many questions but my experience of getting 0 FIR done (in my state) was too bad. I've realized that IPC in 'theory' is v different from how things work on the ground.
