Recovery of token/advance amount from property owner
I made a property purchase agreement with property owner on Rs 100 stamp paper, and he tooks Rs 7.5 lakhs. as token/advance.and PDC cheque of Rs 3.5 lakhs. After that broker of this deal not picking my phone calls he have internal connections with property owner, and broker misguide me and making false verbal commitment to me and trap in this deal . When, I know, that broker and property owner have intension have to past away the last dead line date, then I sent a legal notice to the property owner for deal cancel and refund my Rs 7.5 lakhs and PDC cheque. But, he return back that legal notice claverly . After that I made a recording phone call to him and sent same legal notice on WhatsApp, but, he did not back my money. After that I make a police complain to the SHO, and SSP,, but, he appear to the police and asked that he received rs 7.5 lakhs but, he did not return back because ,in notery agreement money back is not maintain . Forfeit the amount , so I will not return the money, police asked me that it civil matter, we can't lodge FIR in this case you have to go to the court. Now what can I do next for recover my money back. Have any high court or supreme court judgement for recovery of advance or token amount back in case the deal was cancelled. ?
