Partition suit under u/o rule 1&2 read with sec 26 of cpc

I AM PLAINTIFF IN THIS CASE in the year 2021 as my mother defendant no 1 has not allowed to stay in the house and the new construction has been done by me in the 2004 A family arrangements for all family members are paid certain amount by me for release deed of the ancestral property in the year 2005 by way signing by all family members in the Affidavit duly notarized in the year 2005 but not registered and took up building construction by spending huge amount including partial by my mother, now some of family members have come again contesting in the OS CASE for partition of property who are fraudulent cheating me for the building against the ancestral property now in the name of my mother who has transferred the property in her name by all the family members WHO HAVE signed in affidavit and NOC and as they NO CLAIM ON THE PROPERTY, after the building was constructed by me, now how to deal with case against the family members who have cheating me in court of law and present suit filed by me
