Recovery of excess salary amount and reversion back
Dear Sir,
We are 25-30 Stenographers employees from 6 universities in Maharashtra. Our nomenclature was changed and 4 posts were merged into 3 posts in the same cadre of Stenographers. Also our salary was increased as per the posts merged in 2009 as per staffing pattern submitted to State Govt. On 17.12.2018, Govt has issued a GR that the changes in nomenclature and increased salary was not approved by the Finance Department of the Govt hence all these employees should be reversed and recovery of excess salary amount paid should be done. There are some other posts and cadres also. Total 1400 affected employees are there in this case. We all filed petitions at the respective high courts. From our university, we had filed one petition of all affected cadres. Later, all the Petitions were clubbed at Bomay High Court. Bombay High Court appointed a Committee in this case consisting the Govt Officials. On 31.01.2023, Bombay High Court issued final order against all the petitioner employees mentioning it a fraud and misrepresentation due to non approval and concurrence of Finance Department. Now, we have filed a separate petition of Stenographer Cadre in Supreme Court against the judgement of Bombay High Court. We, the Stenographers, are of the opinion that as our posts are merged in the same cadre, from 4 posts to 3 posts, neither our nomenclature was changed nor pay scales were changed. Because after merging of the posts, we were entitled to the respective pay scales of the respective posts to which we are merged. Hence we have e-filed a separate petition of Stenographers Cadre in Supreme Court. I request your precious guidance and advice in this regard please.
