Retrospective promotion
In Odisha Police, in the year 2012, 29 posts of Private Secretary and 04 posts of Sr. Private Secretary were created on 27.02.2012. But, no Service Rule was framed about the eligibility of promotion and no Selection Board was constituted. Odisha Heads of Departments Service(Recruitment & conditions of services of Private Secretaries, Personal Assistants and Stenographers) Rules , 1988 had been framed for other Heads of Departments in respect of the counterparts of Odisha Police Stenographers' Cadre employees. Residency period for promotion of Personal Assistant to the rank of PS is 5 years and residency period for promotion of PS to Sr.PS is 2 years. Odisha State Police Headquarters submitted nomination rolls of eligible PAs to Odisha Home Department for holding DPC for their promotion to the post of PS in the year 2012. But, the DPC was not conducted in the model calendar year on the plea that there is no Service Rule, whereas the Home Department had to frame the said rule while creating such posts and the same was held in the year 2014 basing on the Service Rule made for other Heads of Departments . The employees were deprived of getting timely promotion. Similarly, in the year 2016, nomination rolls of eligible PSs were sent to Home Department for holding DPC for their promotion to the rank of Sr.PS. Here also the DPC was not conducted on the plea that there is no Service Rule. But DPC was conducted in the year 2021 after about 6 years of submission of nomination rolls basing on the said Service Rule. From the year 2012 till date no separate service rule has been made for Odisha Police Personal Assistant and Private Secretary cadre. The employees are being deprived of getting timely promotion. Neither the Odisha Police Organisation nor Odisha Home Department is showing sympathy to the deprived employees. Can the employees take shelter in CAT to get their retrospective promotion?
