Maternity Leave Clause for newly joined employees

Hi Ma'am, My wife joined HDFC bank under HDB payroll on 2nd July 2022. Her conceive status confirmed in end of Aug'22. On 30th Nov22 she was admitted due threatened to abortion cause hence doctor suggested surgery to prevent premature delivery so she has operate on 2nd Dec-22. Since she has been on bed rest and not report office on 3rd Jan23 we visit hospital post examine by doctors suggest for bed rest required one more month. Here we approach her manager and informed the situation and ask for apply Maternity Leave. Because 30th Nov22 to till 2nd Jan it's complete unpaid leaves same we bare. So we ask her manager for maternity leave so he refused and said the job confirmation letter not yet received hence you are not eligible for ML benifits. Please let me know is there any law amendment for new joiners who are awaiting for there job confirmation letter. According to law if any employee continues work for 80 days is qualified for ML benifits. Please correct me. Thanks & Regards Khayyum B.
