I have signed a H1B service agreement with my employer in India

Hi All, I have signed a H1B service agreement with my current employer (a well-known MNC) in India which states “in case employee chooses to terminate the employment FROM THE DATE OF INITIATION OF VISA FEE TILL TWO YEARS FROM THE DATE OF STAMPING”, he/she is liable to payback the Visa expenses incurred which is approximately 7500 USD. Getting into little more details, my H1B was picked and approved in June 2020 but it is not yet stamped (close to 18 months now). I signed that agreement assuming that the Visa stamping would happen immediately after the approval or at the max within 6 months if approval, Which didn’t happen. Now, my HR is showing me the service agreement and asking me to repay the VISA fee. To my knowledge, H1B is an individual asset and employer cannot ask for the expenses from the employee in any which case. But as I signed the service agreement, will I be liable to repay the Visa fee which is approximately 7500 USD ? Request you to suggest me if there is any way I can move out of the organisation smoothly without having to repay the Visa expenses incurred on me. Thank you.
