Posting , Increment and salary after revocation from suspension through court.
Sir,
I work in a department under state Government .
I was placed under suspension by administrative department from 19th may 2019 , while on deputation to ECI ( Election commision). Got released from ECI on 31 may 2019.
Post suspension , I was assigned roaster duties by department , sometime in day n sometime in night in mist of the days from June till 31stAugust 2019, by an order issued .
On the expiry of 90 days , as no reasons were communicated nor any allowances given nor suspension revoked , I wrote to concerned authority for reason, revocation n release of salary or allowances bt to no avail.
At the end of 1 year period , I again requested for the
same bt meet with no reply .
After much persuasion , reason for suspension was given as on ground of utter lack of devotion to duties somewhere in in 2016 and another in 2018 , charged under rule 14 ( major penalty) , to which my reply was submitted denying the charges.
Also, I was assigned and sent for election duty in Dec2020.
Allowances @50% of last pay enjoyed I e of April 2019 , was given from Feb 2021, at random period of months .
In July, 2021, move High court for revocation on suspension n finally on Jan 2022, High court order for immediate revocation.
In Feb- March 2022, I was again send for election duty despite under suspension.
Contempt of court was filed in March 2022 n on 18th may 2022, I was revoked from suspension but with no charges assigned as my post was being held by another official on temporary basis, even though reported for duty.
From May 2022 to June2022, departmental inquiry was held against me . In d enquiry, PO changes all d witnesses mentioned earlier in d chargsheet n brought some officials with whom I had never share work place with as witnesses . Despite protest , EO accepted the witnesses , whom all testify against me .
Brief of both PO n self submitted completed as on 15 th June 2022. Result of the enquiry pending as on dat.
I was given substistance allowances till June 2022. After that I am now without any no allowances nor pay .
When persue, stated that all position are fill up and without having a charge of an office, salary cannot be prepared .
As per employee data, my sanction post is still showing
Vacancy.
Also with regard to salary, Concerned DDO is saying increment from 2018 till 2022 has to be forgo if salary prepared and send to treasury also.
What should be my legal course of action . Plz advice .
If the Departmental enquiry rules against me, inspite of everything, what legal steps can I take . (It might also be worth mentioning that , all the higher posts from the post I was holding to top are being look after on incharge Basis by contemporaries and race with numerous court cases is on among us for promotion n seniority). Please advice where shd I approach and how to cleared of the scripted charges .
