The CIC(R) Act is an imported imposition on the people of India without realising that our legal system is unable to match the American system in speed of justice.
As per the CIC(R ) Act, Section 14 imposes obligations on such companies. They are not merely to follow the diktats of the lender but have to process it and also do research. Rule 21 of Credit Information Company's Rules enjoins upon banks to report disputes to CICs and Rule 26 enjoins upon CICs to report disputes. It is the failure of the CICs to report and account for such disputes that the borrower is left at the mercy of some unethical lenders who are using the CICs to blackmail and extort money. Defamation cases filed are of no avail for several reasons.
The transparency required in computation of credit score is missing. The RBI which has the powers to levy penalties and discipline Banks & CICs prefers to remain a mute spectator. GOD alone can help the borrowers from the loan sharks which the system is aiding and abetting against the citizens of India. The assurances given to Parliament in the parliamentary debates on this matter has come to naught!
