Stuck between the debt taker and lender
Around two years ago, my father's uncle asked to help in financing his 'new business idea'. My father suggested a known micro financer. He took a loan of roughly 30 lacs to buy necessary equipment. But, his business venture failed and Covid-19 didn't help much either. Now, he wasn't able to pay the interest or the actual debt, so he asked my father to pay to help him out for a month, then another, and another. My father has paid roughly 7-8 lacs in interest so far. Now, he stopped answering the calls of the financer and my father. The financer is asking us to pay him up as my father was the one who brought him. My father cannot pay the interest or the debt, as he has been facing his own financial difficulties. The uncle's wife has threatened to commit suicide and write my father and the lender as being liable for their death. The uncle has some properties that he can sell, but his adult children are preventing the sale of assets. This fiasco is taking an emotional toll on family relations. In my option, I want my father to file a case but he has been hesitant and doesn't want to. The lender has also threatened to lodge a case against the uncle, but he hasn't done it yet, as my father was paying the interest until now. But, I don't know what the lender will do now, as my father cannot pay anymore.
What can my father do to get out of this mess? Is there a legal case here?
