My apartment association doesn't accept membership.
Hi... I recently bought a flat in Bangalore. The flat was bought directly from the builder. This flat was vacant for the last 15 years and the builder didn't pay the monthly maintenance charges. When we visited the flat to check the works that had been done just before the registry, the property manager told us that there's amount pending and that must be cleared.
Now we weren't aware about this and we travelled from a different state once the loan had been approved and all the formalities had been completed, so were completely frazzled.
So, we asked the people who we were dealing with from the builder side , to not get registry done until the amount is cleared coz we can't take that on our head.
So, they called us to their head office and convinced us that that won't happen and also, promised to give us an indemnity agreement so we can rest assured that we don't have to pay the maintenance arrears.
After everything is done, we went and asked the society association to accept our membership by submitting all the documents but they refused saying if we accept your membership,we will have to put all the arrear bill on your name.
We showed them the indemnity agreement and they are aware that it's between them and builder.
We have a huge loan on our head and we were relying to pay off the monthly EMIs by putting the flat on rent.
Now the society association is threatening us by saying if you put a tenant, we will not accept their tenantship plus we will do what's in our hands. We will not give you the DG supply and also, the security/housekeepin services will be affected for your tenant.
In all these, the builder says that we don't need to worry and can put a tenant coz legally society can't stop us.
The society association has added interest on the maintenance amount and asking for almost double of what's pending which the builder isn't agreeing to, so there might be a legal case in between the two in future.
We are now only worried that how will we start to pay the EMIs , if we can't put the tenant and what if we put and the society creates a problem.
We don't know what to do.
Should we file a case? But against whom? The builder or the society association?
