Bank E Auction property which is mortgage to bank
1. Property is not transferred to borrowers name in right of record’s.
2. As the property is in borrowed mother’s name.
3. While taking loan borrower she has shared a copy of will written by her mother stating this property should be given to the daughters X and Y. (Will is not registered in court)
4. Copy of concern deed is shared with bank stating we all agree to transfer the property to X and Y.(Concern deed is not registered in court)
5.Bank has original sale deed
—> With the above details bank has mortgaged the property and provided the loan and it was registered in Banglore sub-register but property is other city of Karnataka.
After E Auction the bidder has asked the details of property and found that property still not been transferred to borrowers name From her mother still after ten years.
Now after bidder raised concerns now bank has taken up with sub-registere to get update Encumbrances certificate.
As bidder should I go pay full amount for bank to get the property or ask my EMD back from bank as bank has failed to collect documents from borrowers
