Conflict of Interest
Accordingly, you hereby agree that during the period of your employment with the Company and for a period of 1(One) year after the termination of your employment, you shall not, directly or indirectly, and whether or not for compensation, either on your own behalf or as an employee, officer, agent, consultant, director, owner, partner, shareholder, investor, or in any other capacity (except in the capacity of an employee of the Company acting for the benefit of the Company): (i) provide services to a customer/vendor/competitor of the Company; and/or (ii) assist in any way, any person or entity whose activities are competitive with or otherwise adverse to the Company’s own business activities.
Above is the conflict of interest clause in my offer letter.
1. I am working in the partner company of OEM and have got another offer. If i want to move to OEM do i need to have a cooling period of 1 year to join the OEM. Can i directly join OEM. What is legal action possible for my company to take against me ? is there any clause of not allowing an employee join OEMs even after employee getting releived normally with out any dues.
