Without Serving Notice Period
One of my friend working in IT company , After 20days of Joining date, due to Family Issues he asked for 2months leave , but Company didn't approved the leaves and they said that to Employee after 1month of time, So he requested that he will be back to work after 10days as already 1month of time Over, but no response from Company meanwhile they dropped mail as Absconded and removed Access to Company portal , he dropped mails to HR and Team saying he will resume his work but no response from them.
They removed access to Company portal so that he cannot apply for resignation and They didn't Informed at least to Serve Notice Period, directly they marked as Absconded.
Actually the Issue which I know is they Recruited him for project, but that Project Contract not extended so no work for him in New Project. Team got opportunity to get rid of this employee has they don't have project. Team cannot release that Employee to Bench because new recruitment candidate and they have to answer HR.
After 5months Company dropped mail to pay Amount for not Serving Notice Period as 3 months Salary
in Full and Final Settlement to pay 3 months Gross Salary to Company.
1.what will happen if he wont pay that Money? will be any legal action on him
2.Company didn't responded when employee said he will back to work. If they allowed him to work or Serve Notice period He would have been done that.
