NPA/NCA - Indian Company to American Company (Client) - Direct Employment
Hello Sir/Ma'am
I am currently employed in Company X - that is a service provider for an American Company.
Last week we got to know that the Client (American Company) is no longer going to extend the contract and the process is going to end on 30 May.
On the side, the Client has reached out to me and few other colleagues of mine (as we were top performers) to join the American company directly on their payrolls.
Our India company X got to know about this and they are stating that we have singed some kind on Non-Poaching/Non-Compete agreement in our hiring process that they plan to enforce by preventing the Client (American company) from hiring us.
Point to note is that the Client offered us job directly and asked us to begin work from 1 June, which will be day after we resign from current Indian company.
My question here is,
1. Is it possible for the Indian company to prevent me from joining the client directly even after I resign?
2. Can they (by any means) influence the American Company to take the offer back that was given to us?
3. What options do I have as an employee to fight again this?
