Notice Period on Probation
Hi,
I have joined an Organization on 18th of April. They have a probationary period of 6 months. After joining the company I have realized that they have made some false promises to me.
I want to quit on 1 weeks notice. Can I do that without any legal issues?
They have the following clauses written in the offer letter.
a) Either party can terminate this employment by serving a one month notice to other party. <Company Name> may at its absolute discretion make a payment representing salary (basic) in lieu of notice
of termination. However, for the cause like misconduct, gross negligence, misbehaviour or non performance, <Company Name> may terminate your services with immediate notice. <Company Name> shall have
the right to suspend you pending an investigation into potential dishonesty, gross misconduct,
misappropriation, gross negligence, fraud or other circumstances (if proved) would entitle <Company Name>
to dismiss your services summarily.
b) During the Probationary Period, six (6) months from the first day of employment, <Company Name>
may terminate your services with immediate notice at Client`s request.
c) In the case of Employees who are governed by service agreement for serving a minimum
stipulated period, the employee can exercise option under clause 3(a) only on their completion of the
stipulated service period agreed to and provided therein.
d) Unauthorized absence or absence without permission from duty for a continuous period of 7
days, would make you lose your lien on employment. In such a case, your employment shall
automatically come to an end without any notice of termination.
e) You will be governed by the <Company Name> laid down Code of Conduct or policies in place from
time to time and if there is any breach of the same or non-performance of contractual obligation or
the terms and conditions laid down in this agreement, your service could be terminated without any
notice notwithstanding any other terms and conditions stipulated herein. <Company Name> further reserves
the right to invoke other legal remedies as it deems fit to protect its legitimate interests.
f) Reference check will be made from your previous employers, in case there is any adverse
report against you which may be detrimental to the interest of <Company Name> or if the information
furnished by you is not true, <Company Name> reserves the right to terminate your services forthwith
(notwithstanding any other provisions) on the grounds of misrepresentation of facts.
Please help me in this regrad.
