Breaking Company Bond
I have been working with a Company and was in a bond on stamp paper for 2 years where there is no exit clause to resign on any grounds, if it is done I am liable to pay 6 months salary. There is no paid training that company had done. I worked for a year and resigned on basis of medical reasons for which I have submitted proofs. I have been facing health complications due to long distance travelling it takes me 2 and a half hr to reach office and similar time coming back. I have all medical records and papers for last 6 months. Moreover I was not liking the environment and it was mentally stressful for me. I got a better opportunity and I moved out with immediate resignation. They have a policy newer employees who joined after a specific date have to sit for 9 hrs and older employees for 8 hrs. Plus they have no paid maternity. They give sabitical. They ask us to bear the travelling expense even for company meetings. This was not exactly opposite of what they told when I was joining. After fighting they reduce the amount to 50% after which I can get reimbursement. Like how can a sales job expect us to do expense for company meetings. Now they did an appraisal for which they again got us signed wherein I was already in a bond. Also, they withdrew the 50% cut and included whole component in my salary for travelling hence impacting the raise. The new signing states that I can't leave until 1 year and after that serve 3 months notice. They asked back company's asset and handover and agreed resignation on phone but no written commitment. After a week they contacted my husband as we are in the same industry and asked him if I joined the competition and there is lot of confidential data that was disclosed during the tenure. I am in sales so there was no specific data as confidential. He said HR will take steps to protect the company. What are the legal implications they can take. I haven't asked them experience letter as the new company understood it and are ok with the same. I am worried about what can they do as they forcefully have recovered money from previous employees who left. Like new company is nearby, I am working from for a while they are understanding, maternity leaves and all perks. I am worried it shouldn't impact my new job and I don't have money to pay them. Please help.
