Salary not paid since 2 months - Serve notice period or not?

State - Gujarat Company registered in Chennai 100% remote job Hello guys, So I joined this startup on Dec 1, 2021. My first salary was supposed to come by 1st week of January 2022. I messaged my CEO when it did not, and I got it on Jan 10th, 2022. Next, the salary for Jan was supposed to be credited in Feb but my CEO messaged me asking if I could take 2 months' salary altogether to which I agreed. Come forward to March, I was supposed to receive the salary for Jan and Feb and still did not receive them. I mailed my CEO that I need my salary and after a few days, he sent a company-wide mail that there are some financial constraints in the company due to which he has not paid the employees as well as our vendor. He basically asked us to leave if we want and he will give us the experience letter. Due to the financial constraints and the stress he has caused on me, I decided to leave the company and look for other opportunities. And I got one company and they are willing to wait for me to serve the notice period. So, Do I have to serve the notice period? I don't think he will provide me reliving letter regardless. The other company I am joining is ready to wait for me. I don't mind waiting for a month but what if I don't get a relieving letter from the present company? How do I explain to the new company that I don't have a relieving letter? I can just say that I resign and did not serve the notice period since he hasn't paid me the salary. I am scared of this option because what if he serves me legal notice in the future that I didn't serve the notice period or something like that Also there is no work currently, so even if I am serving the notice period, I won't have work to do. Even the HR dept ain't paid.
