I have a new job starting in the mid of April 2022 but cu company wants me to serve 3 months notice.
So i asked my HR manager regarding my notice period and they said although its 90 days but can also be relaxed to 30 days and can also be relaxed to lesser than 30 days. I conveyed the same to my new employer and got the job.
After giving my resignation to my current employer mentioning 30 days of notice period, they reverted back to me telling me that i have to serve full 90 days of notice period.
I have a clause in my offer letter which states this:
"Term of Employment/Termination: Your employment will commence on your start date and shall
continue in force and effect for an Initial Term of two years, unless terminated sooner or extended
as provided by the terms of this Offer Letter. This Offer Letter shall be subject to automatic
renewal on a year-to-year basis. You will be bond to be with the company to finish your job
responsibilities for the period of two years unless under certain circumstances, both you and
company agrees to terminate the employment contract by giving three months written notice.
The penalty to not complete the bond period is equivalent to 6 months of salary deduction. After
the bond period, ninety days (90) days’ notice of intent not to renew this Offer letter or intent to
terminate this Offer Letter /your employment should be provided. Advance Solutions may
terminate this Offer Letter/your employment immediately (without notice) for Cause. “Cause” is
defined as: (i) any material breach by you of this Offer Letter;(ii) your repeated failure or refusal
to perform any material duties of your position; (iii) your gross negligence or willful misconduct
in performing any of your duties; or (iv) your conviction of or pleading guilty to any crime involving theft, embezzlement, or that constitutes a felony in the jurisdiction involved; (v) Poor Job
performance"
Can anyone help me that what i can do to get relieved earlier. Am i in a big problem?
P.S: I am from India but the company is headquartered in USA.
Edit: I have completed my 2 years with this company and haven't signed anything new that states regarding any new policy for Notice periods or anything.
