Applicability of Summary Suit order 37 of CPC on loaned money through cheque with no promissory note

1. I paid approx 15 lakh in 5-6 tranches between 01 Jan 18 to 30 Sep 2019 by cheques favouring a friend of mine to help and sustain/improve his business. No written document is there. However I have following: (a) Many whattsapp message sent to him and seen by him regarding returining money ( he has seen messages but not replied). (b) Many Call recording on phone beteen myself and him where he has been pleading to give more time due to corona and promising to return money soon. (c) Similarly, many similar phone between my wife and his wife, where his wife is assuring to return money. (d) I have proof of him returning me 1.5 lakh where he deposited money in my account (e) As I wanted him to show proof of utilisation of my money paid to him, he submitted me large number of his hand written sale purchase bills and records. (f) Bank statements as proof mentioning clearance of cheque favouring him. 2. I filed complain in local police station about him non returning of money, where he gave false statement that all cheques he deposited in his account and paid me equivalent amount in cash. I want to know, can I file Summary Suit order 37 of CPC 1908 in this case ? (Does bank transctions and phone conversation recording prove admitting liability which is one of the main requirement for Suit order 37). If I cant file under order 37, then what is best course of action i.e. under which section I should proceed. Also Kindly suggest if any other means to recover my 100 % white money (actually it was my saving/pension/salary/PPF amount)
