Not accepting my resignation for 1 month for non confirmation of employment
I joined Dec 2020 and was on probation for 6 months, I gave resignation on 2nd Feb 2022 and as per appointment letter if I am on probation I need to serve 1 month notice period and I am ready to serve 1 month notice but HR is saying that you are confirmed employee and you need to serve 3 months notice period, as per the annexture 2 I have not got intimidated in writing regarding my confirmation
I even agreed to pay remaining 2 months basic salary as mentioned in my appointment letter buy they are saying no and demanding me to serve 3 months notice in any cost
*"Annexture 2 You will be initially on probation for a period of Six Months, which may be extended or reduced at the
sole discretion of the Management. During the period of probation, the appointment is terminable by
giving 30 days' notice in writing by either side or payment of 30 days Basic salary in lieu thereof. On
completion of initial probation period till such time that you are intimated in writing regarding your
confirmation, you shall continue to be on probation. After confirmation, the employment can end through
three months' notice or payment of Basic salary in lieu thereof by either side. You shall attend duties till
you are relieved from services in writing. Waiving the Notice Period on resignation is at the sole
discretion of the company"*
