Imitation period of an order u/s 151 for interim maintenance payable by defendant to the plaintiff
The Plaintiff in a partition suit sought decree, which was challenged by Defendant before the 1st Appellate Court. The Plaintiff sought 1st Appellate Court's Order u/s 151 of CPC for interim maintenance to be deposited by Defendant in Trial Court each month. This order u/s 151 has not been challenged by the Defendant, but the Defendant has not obeyed the said order for last 4 years. The said order u/s 151 thus reached finality and still subsists. After passing this order u/s 151, the 1st Appellate Court allowed the appeal and remitted the suit to the Trial Court for allowing the heirs of one of the deceased defendants to file their say, which was already filed before the 1st Appellate Court. Hence the said remand order has been challenged by the Plaintiff before High Court, where its hearing is pending. Can the Plaintiff apply before the Trial Court for execution of the 1st Appellate Court's Order u/s 151 ? What is the limitation period for filing such application ? under which article of Limitation Act 1963 ?
