Dual Employment over unavoidable circumstances
A person who is working under central government, he went on leave to his hometown. unfortunately some accident or disease happened to him, he became physically unfit to do work means can't travel to workplace on daily basis.His work requires physical fitness to do perform his regular duty. But doctor told till it cure he needs to take bed rest, it may take 6 months or may be one year to cure.He submitted his medical certificate to his office. He has only 10 days granted medical leave, assume he used EL which remained on his account also. Situation came like he doesn't have any leave in his account. Government told him that you can take EOL or special leave without pay. Now his payment has been holding by the government.He is not getting salary for his livelihood. He is the only earning member of his family, 4 persons are depending on him.he has a personal loan so that he needs to pay monthly EMIs as well. Now the question is,
He has good knowledge over computer or Software feild. So he decided to do work from home job for any IT company so that by using that salary he can manage to pay EMIs and livelihood expenses.
Case 1. In this situation does he do that job,because he is just physically unfit not mentally. He is a able to do job in computer. In this situation does it valid or legit to do job in IT firm ?
Case.2. You all may say take permission or NOC from his office .
So he asked but his office denied and said he can't work
(i) they ask him to resign and go but he has temporary
physical unfit. He will be alright within 6 to 12
months
(ii) they told that we will provide you special leave but
without pay. But pay is our main requirement.
What can he do in this case.
Case..3. Obviously in the IT firm if you say that you are already employed in central govt they will not hire you.so here he needs to hide that from them. Is there any chances to find that I am already employed under govt sector through my pan or PF deduction?
What are the possible solution to this problem.
WHAT SHOULD HE DO FOR LIVELIHOOD?
