Notice Period Recovery Amount from Tech Mahindra
Hello Sir,
I had joined Tech Mahindra on 11-Jan-2022. But after that I got an better offer from another company so I decided to resign from Tech Mahindra & officially submitted my resignation in the HR portal on 12-Jan-2022. I was not onboarded into any project. They have a notice period of 90 days & since I didn't want to serve 90 days notice period I asked them for early release. So they released me on 13-Jan-2022 by sending an email. I had only 3 days of employment with them.
Now on 28-Jan-2022, I have received a negative Full & Final Settlement mail in which they are asking for Notice Period recovery amount of 88 days which includes Basic pay of 3 months. Also at the time of joining they had offered me joining bonus of 50,000/- but it was supposed to be paid only after completing the 3 months in the organization & in the joining bonus letter they had mentioned that if employee leaves company within 1 year then the joining bonus amount would be recovered.
Now in the Full & Final Settlement they have also included the joining bonus amount. So I have below mentioned 3 questions regarding this.
1) Is it legal that they are including the joining bonus amount also in the Full & Final Settlement even if it is not paid to me at all?
2) Since I did neither took any salary nor any benefits from the company am I still liable to pay the
Notice Period Recovery amount?
3) If I don't pay this amount to Tech Mahindra is there a chance that they will take this thing to court?
