Compensation claim for ola auto negligence

Hello all, warm greetings. I'm Kumar here from Bengaluru. 4 days ago i unfortunately met with a near fatal road accident which resulted in breakage of my nose which had to be surgically set by an operation in a hospital. I was in the hospital for 5 days without any help and support. On that day when it happened I had hired an Ola Auto to reach home from a friend's place. The driver of the Ola Auto was very rash and ended in an accident involving another two wheeler. I was the only passenger in the auto and I was hurt very every badly and has to be immediately hospitalized. Later police attended me in the hospital and confirmed the incident. They have taken my case. Now the surgeon who operated me told me that I need 6 months of medication and rest before continuing my business work. I haven't yet claimed any insurance for I was told in medico legal cases it wont be cleared. So I have to borrow money to clear hospital bills. Now I want to file a very strong case against rash driving of ola auto driver, the other byke driver involved and claim penalty for my financial and permanent body damage losses. I'm from Bangalore. Please anyone advice me
