Not wanting to serve 60 days notice period
Hi. I'm having a contract with a firm based out of UAE, and i'm working in their tech hub in India. The firm is registered in UAE only and not a registered firm in India, my contract is as a consultant working from India. The contract also mentions that 'This agreement shall be governed and constructed in accordance with the applicable laws of UAE and the courts of Dubai shall have full jurisdiction to resolve any difference or dispute arising out of it.'
The issue i have is the contract mentions a 60 days notice period. But i have got a better offer now elsewhere and i do not want to complete the 60 days notice period, but serve only 30 days notice period. The company is forcing me to finish my 60 days notice period, which if i do i will lose my new offer.
I would like to know what are my legal obligations here please. Especially since the company is not registered in India and im an employee in India for them. Can i adjust the notice period with my remaining leaves? What are the options i have? Wil i be in trouble if i leave after 30 days without agreeing to finish the 60 days notice period.
