Old vehicle ownership transfer issue
My old two wheeler Scooty pep+ was exchanged at a showroom 3years back while purchasing a new vehicle. The delivery note has the signature of the then manager of the showroom and is not having the seal of the showroom, who now is no more an employee of that showroom. I am in touch with him regarding the transfer of ownership which has not been done owing to many reasons given by him. According to him, the vehicle was not found useable by the buyer, who in turn put the vehicle for scrapping. The ex-manager, after my follow-ups is saying that he is attempting to get the scrap certificate done. According to information on internet, before the vehicle is put to scrapping, it should be taken to the RTO, and the registration should be cancelled and the after de-registering the vehicle, the vehicle should be given to the scrap dealer. In my opinion, this rule has not been followed by the buyer of the vehicle, and he has put the vehicle for scrapping before the de-registration process. The manager, with whom I'm in touch is saying that as I have the delivery note with me, I need not be worried as the responsibility of the vehicle in case of any mishaps, lies with him and not with me. Is this legally valid? Am I not responsible towards the vehicle in the event of anything going wrong? He has however requested for sometime for him to do the needful. What as per law is needed to be known by me and what do I need to do?
Ps: According to the ex-manager, he is looking into the matter, as the delivery note has his signature and the vehicle was given to third party vendor by the showroom after it has handed over by me and later the vehicle got sold to one of his friend who further could not use the vehicle.
