Not Serving notice period due to loss of pay
Hello there,
I joined a company 3 months back.
After 2 months, project was allocated and while I was working, I started facing numerous issues where team was not helping, even not providing required training to work, I even extended working hours to make sure the work is in progress, it was so wired that whenever i was asking a question they would say go do google search. Everyday, whenever I opened my laptop it felt like, I did joined this company for this and it was mentally tiring, so i decided to quit on health grounds.
As, I was in probation, I asked for reduction in notice period and leave the organization, i just dont want to work for them. The notice period for 3 months in probation.
I even said that they can keep the salary and i am ready to buy out but they did not agree, and as a solution they asked me to go on 2 month loss of pay and serve one month. I was ready to serve it but 2 month loss of pay was not agreeable. After so many emails, they would say we do not encourage early exits, and due to this i decided to turn off the laptop and marked the last email to hr, hr head and manager that i wont be able to continue and loss of pay is not an option.
I served notice for around a month, and decided move on and join another firm after sometime.
I want to know.
Can they take any legal action and mark me as an absconded?
The HR said, If i leave in this way, they will mark me as an absconder and i wont be avle to work in any good companies.
Is it as an employee, we dont have any right to defend ourself? Is it only the employer way ro work, reduce notice period, i could not cotinue, so I quit,it was not working for me.
Can they literally ruin my career??
I have repeatedly asked them ways to return joining bonus over email, which they havent responded, till the last day. Neither, I intend to have that, I am capable enough to return that amount.
I dont want any legal issues, as i plan to move outside india for my studies in sometime.
Please advice.
