I have 2 month notice period but i want release in 1 month
Below is details from my offer letter.My company is not allowing me release in 1 month and not accepting my offer to pay basic salary for that pending time.What can i do ?
7. Termination of Employment and Notice Period
7.1 The Employer reserves the right to terminate your services
During the course of Probation period, your employment with the Employer can be terminated either by
the Employer by giving you (2) weeks’ notice or by you by giving 2 months advance notice to Employer.
During the course of employment post probation period, your employment with the Employer can also
be terminated either by the Employer or by you by giving the other party 2 months advance notice. If the
Employer chooses to terminate the employment and decides to relieve you before the completion of the
notice period, the “Basic” component of the last drawn salary for the balance notice period will be paid
to you. If at your request, the Employer agrees to relieve you before serving the full notice period, you
will be liable to pay the Employer the “Basic” component of the last drawn salary for the balance notice
period. However, the acceptance of any early release request would be at the sole discretion of the
Employer.
During any course of the employment, the Employer reserves the right to terminate your employment
without notice or salary in lieu of notice in appropriate circumstances. Appropriate circumstances
include, but are not limited to situations of misrepresentation of qualification on job application, gross
misconduct, gross incompetence and/or gross negligence.
At the time of termination of your employment for any reason, you shall comply with the Employers
termination procedures, sign all documents and return all Company property. The Employer will not be
bound to pay the dues, if any, till you have completed the separation procedure.
