Study leave
I am a primary school teacher and applied for study leave on 2017. The reply was delayed for three yearsand on 06/12/2020 Department sent a mail to the principal and asked,
1. "whether he (me) is willing to undergo M.Ed (Master of Education) course on Extra Ordinary leave on Loss of Pay...". I replied on 09/12/2020 to the department through the proper channel, that is
2. ..."I am not willing to pursue my course on loss of pay. Moreover, I being the bread winner of the family it will not possible for to go loss of pay for two years.
3. On 16/12/2020 Department of Education send me a detailed letter and rejected my Study Leave. Reasons shown in the letter is:
(a) As per Rule 50 (1) of the CCS (leave) 1972 it is stated that, subject to conditions specified in the specific relevant chapter, study leave may be granted to a government servant with due regard to the exigencies of public service to enable him to undergo, a special course of study consisting of higher studies or specialised training in a professional or a technical subject having a direct and close connection with the sphere of his duty. No such kind of circumstances exists in this case. Sub rule 3 of Rule 50 says "Study Leave Shall not be granted unless (1) it is certified by the authority competent to grant leave that the proposed course of study or training shall be definite advantage from the point of view of public interest". No such public interest is involved, it is purely personal interest.
