Can Employer deny for notice period buyouts/pay and treat as absconding if not serving notice
Hi, I resigned from the company on the same month of joining ( worked only for 30 days). I initiated formal resignation in the system and requested employer to release me early as possible and I'm ready to pay for the remaining days of notice period on my own. In the offer letter employer stated " As a regular employee, you will be required to give three months’ notice or salary thereof in case you decide to leave
our services, subject to the Company's discretion. Where circumstances make it necessary, the Company will have
the discretion to relieve you only at the end of the three months’ notice period. Similarly, the Company can terminate
your services by giving three months’ notice or salary thereof."
Though I'm ready to serve 1 month notice and pay for remaining 2months ,but company is not providing me this payout option for 2 months notice. I don't have any knowledge dependency in the system and ready to surrender all the properties belonging to company immediately. But employer is saying that it will be treated as absconding case if I'm not willing to work and don't serve 3 months notice.
Can employer could take legal action on me even after I'm ready to pay for notice ( but they deny for it ) and surrender all the belongings ? Please advise.
