Withholding salary
I am working as a documentalist in the central library of the premier Govt. Medical college of my union territory.My salary alongwith 4 other colleagues of mine has been withheld by our I/C HOD for 5 months now. The reason being his ego. A few days after assuming the charge of chief librarian, he took our attendance register to his pathology department and asked the library clerk to inform verbally all library employees to mark their attendance in the corridor of his department which is unethical. He did this to avoid coming to library inorder to save his time. Although as a head of the department it is his duty to visit library and look after its proper functioning which he never bothered about. Of all the library staff, me and my 4 colleagues didn't go to mark our attendance in his pathology department but we used to duly mark our attendance on biometric system installed in our department which is the mandatory attendance as per GAD orders.Once we completed our one month of duty under him, he served us an explanation as to why action should not be taken against us in contravention of his order for marking manual attendance in his department. In reply to his explanation, we wrote that there was no written order issued by him in this regard which we didn't obey. Besides that we are marking our attendance biometrically which is the authentic and valid proof of our presence on duty. After receiving our reply, he went to Principal of GMC to complaint about us. She being a doctor herself blindly supported him without verifying the facts and asked him to take strict action against us. Since that day he never forwarded our attendance to accounts section for disbursement of salary. All this happened during tough times of second wave of covid. The administration didn't stop there. After 2 months, they issued a chargesheet in our name, again asking us to explain why action should not be initiated against us. We replied with strong arguments to which they responded by attaching one of my colleagues to administrators office. We met administrator of the college to discuss this matter. He told us to mark the attendance manually in his department and assured us to release our salary as soon as we do so. On his assurance we started marking our attendance in pathology department like our other staff members and also personally apologised to our l/c HOD incase he was hurt by our resistance to marking attendance in his department. Despite all our efforts to amicably resolve the issue, we have been suffering since 5 months without salary. Our HOD alongwith the entire administration of the college is responsible for this injustice being done to us. Our salary is being withheld illegally. Now we are left with no option but to take legal route. Please help with legal suggestions. Thanking you in advance.
