Signed an employment agreement but do not want to join the company
Hello,
I have recently signed an employment agreement for a company but now I do not want to join the company. Joining date is in next few days.
In the employment agreement there was no penalty clause as such...
A clause which is concerning me is this:
""Legal and Equitable Remedies. You acknowledge that
the provisions of the Agreement are reasonable and
necessary to protect the legitimate interests of company, and that any breach by you, or any agent acting
under your direction or at your request, of this Agreement, will cause immediate and
irreparable damage to company. You acknowledge that
a breach by you, or any agent acting under your direction or
at your request, of Section 9 of this Agreement involving
physical property containing or disclosing Confidential
Information, Third Party Information, and/or Developments,
will cause immediate and irreparable damage to the company. You agree that the company, its successors,
and assigns may enforce this Agreement, whether they may
be seeking damages at law or equitable relief, such as a
temporary restraining order, preliminary and/or other
injunctive relief, an order for specific performance, and other
equitable relief for breaches and threatened breaches of this
Agreement. You agree that no bond or other security shall be
required in obtaining equitable relief. You also understand
that other action may be taken and remedies enforced
against you, and this Agreement shall not in any way limit
remedies in equity or law otherwise available to the company. You agree to reimburse the company for
reasonable attorney’s fees and costs incurred in the event of
your breach of this Agreement, should company seek
to enforce this Agreement against you.""
what will be the consequences of me not joining the company?
Is this agreement enforceable even though I haven't joined yet(not employed).
please help
