Recovery of Arrears Maintenance and Service Charges

For the last 15 years the Vendor is providing facilities and services as per Schedule I & II of the Fourth Schedule for the common areas as described in the Third Schedule which includes lift, security, car parking, sewage and drainage maintenance, painting of building, keeping common areas clean, engaging sweepers, caretakers and security personnel etc as building is used for commercial purposes. It is stipulated in the registered Deed of Conveyance that Maintenance and Service Charges will have to be paid to the Vendor at certain rate which can be enhanced as per the rising costs of goods and materials. Charging of default interest is also stipulated in the registered Deed of Conveyance. Inspite of several meetings the Owners and / or the Occupiers of the building are refusing to pay any enhanced rate neither have they any amount for using the services and facilities by the Vendor for the last 15. The Vendor at its own expenses has provided such services but he can no longer bear the losses. He has carried on the duties and responsibilities due to long standing association with the Owners and / or the Occupants but can do no more. How can the Vendor recover the dues of the last 15 years? Please Help.
