Early Reliving
Termination by either Party without cause: Either Party may terminate the Agreement by giving written notice
of at least 90(ninety) days to the other Party. Unless otherwise agreed in writing by the Parties, the termination would
be effective only after 90(ninety) days from the date of the receipt (by the other Party) of such notice (hereinafter
referred to as the “Notice Period”). Alternatively, the Company may terminate your employment with immediate
effect, upon giving you salary in lieu of notice or pro-rated salary for the balance Notice Period in case you have been
permitted to work during the Notice Period. In case you have given a notice to resign or terminate your employment
or resign from services, you are expected and required to diligently serve the entire notice period.
Should the Employee fail to serve the notice period, he shall be liable to pay an amount equivalent to the salary in
lieu of notice (for the duration of the Notice Period) or pro-rated salary for the balance Notice Period.
My Employer asking me to serve 90 days where I am ready to serve only 42 days because I have to join new company and I am also ready to pay notice pay. Please guide me can my employer force me to work? Will he issue reliving letter?
