Whether stay order by which court on auction of gold by private bank against rbi's moratorium allowd
RESPECTED MA'AM/SIRS, RBI allowing moratorium of (deferment of loan for 2 years) to ALL INDIVIDUAL BORROWERS (as per RBI's PUBLIC Notification dt. 05.05.2021) under Resolution Framework 2.0 under 2nd National Lockdown crisis for loans taken in 2020; Further also in the Notification's Para No.16 specifically allowing to upgrade any Loan A/c. which has turned as N.P.A. after 31st march, 2021 prior to implementing this notification. The Notification is addressed to all the Banks including the Private/Foreign Banks also. Here, the private Bank (Scheduled Bank) has given a letter with "False" mention that there is no such R.B.I Notification of moratorium though I have shown the necessary proof downloaded from the RBI Website to the bank with the Notification proof/Details. Yet, the bank/branch staff habitually wish to enforce the illegal and unauthorised auction to "favoured bidder". despite my complaint to R.B.I. C.M.S. grievances (C.M.S. = COMPLAINT MONITORING SYSTEMS of RBI), However, the R.B.I. Staff also have not taken action yet for the obvious reasons of hidden support to the Bank and the R.B.I. officials don't pick up any of the landline calls mentioned on their website. The Private bank has also faulty policy as on due date of renewal the bank has arbitrarily raised margin to about 40% though R.B.I. has lowered and allowing only 10% margin with 90% L.T..V. (Loan to Value). so the Private Bank is suffocating the gold borrowers either to arrange for more gold for the :artificial: shortage in value or face the auction for sale of the precious gold ornaments of wife under medical treatment.. Here, the borrower (husband) has lost the income source also during the 2nd national Lockdown, so he is eligible for R.B.I.'s moratorium but the culprit Private Bank branch staff bent on auction to rob the borrowers of the precious gold ornament of his wife. His wife is handicapped, feeble due to 2 (Two) major bone surgeries with implant. the borrower's condition is also pitiable. Kindly
