Denial of Experience certificate and NOC.

Sir, I am a Central Govt employee and served for more than 6 years. My post is an isolated technical post and there are no promotional aspects in the future. Having requisite educational qualifications, I had requested my employer for an experience certificate along with a NOC for a higher post in other Ministry. The NOC and experience certificate was rejected citing, as there is no sufficient staff strength and in the public interest, your application for the issue of experience certificate and NOC is rejected. I received the letter after the application date is over. In this situation, if certain higher posts in other Ministries come in the future, the institute will furnish the same reasons. It was uncertain, whether I will get that post or not, but merely facing the interview was important. The constitution of India guarantees the right to equality, but if we can't get the chance to face any interview, then what's the meaning of equality. Mr. Ajay Sethi, Advocate, Mumbai said, Government cannot refuse to give a no-objection certificate (NOC) to an employee on "vexatious technical grounds" if no public interest was involved, Central Administrative Tribunal has said. Denial to grant NOC is not sustainable as it is not the case of any Ministry that there is a shortage of officers and the applicant's departure would be greatly inconvenient...Neither public interest is pleaded nor could it be established,". In this situation, what can be done to get a NOC in future, kindly suggest.
