Resignation vs Technical Resignation
I have joined the Government of West Bengal in 14 September 2005. Then, I was issued NOC on 30 September 2005 for appearing in SSC interview where my application was submitted before joining the Govt. of West Bengal. Then, I had submitted resignation and did not mention the term 'Technical' in my resignation letter. Then, I joined Indian Audit and Accounts Department, Govt of India after being released from the Govt of West Bengal.
In this connection, I want to mention here that the DoPT, Government of India has clearly stipulated the conditions that if an employee joins the service and and resign to join another service for which he had applied before joining the first service, his resignation will be treated as technical resignation under three conditions:
1. He had intimated the authority immediately after joining the first service.
2. He had informed in his resignation letter that he wants to join another service.
3. The authority was in the opinion that if he had been in the service, his application would forwarded through proper channel.
Considering the above facts, my question is
1. Whether the Government of West Bengal has any circular/office order/memorandum etc. regarding consideration of resignation as technical resignation if the employee does not mention the term 'technical' in his resignation letter as OMs of DoPT, Govt of West Bengal. If so, under which condition?
2. Whether the DoPT OM is applicable for Govt of WB also.
