Working policy of resident doctors in NBE
I am doctor who is pursuing PG via NBE. I have been asked to work 70-90 hours per week/320-380 hours per month, by my insitute, with only 30 leaves(given officially on nbe website, but mentions excluding regular offs and public holidays), also includes 28-30 hours of continuous shifts, 2-3 times a week. We are not given any week/monthly offs at all. This has taken toll over me causing mental and physical exertion. Once in a while if we get a week off in a month, that also is deducted from 30 leaves (leaves that i did not apply). On filing RTI at NBE regarding working hours, they mentioned it is at discretion of institute, and institute is making us work these hours and not ready to give anything in writing, also no grevience reddressal committee as HOD owns the institute. Kindly guide, whether As per the directives of the Honourable Supreme Court in its judgment dated,25.9.87, in writ petition No. 348-352 of 1985, all the State Governments, Medical Institutions and Universities are required to amend their rules and regulations to introduce a uniform residency scheme by 1993, we cannot be made to do more than 48 hours per week.
If i file a case, against whom should i build my case?
Does the above supreme court law hold true even now?
If yes, what are my chances of fighting against this atrocities against inhuman working of students.
Also does this involve human rights violation?
Medical PG students come under labour law?
