Notice Period Issue

Dear Sir's, Myself Ravi Pal, I am a private employee working in a Chinese MNC(YANFENG INDIA AUTOMOTIVE INTERIOR SYSTEMS PVT. LTD) situated in Sanand GIDC from last 2Y 10M and rightnow Serving Notice Period. As I have resigned on 27th Feb 2021 and as per Terms of Employment my notice period is 3 MOnths, I am not able to serve my notice period as my future employer ask me to join asap & also ready to pay short notice pay so need to get relieved within 1 Month i.e. 3rd April 2021 . Even II am ready to pay Gross Pay for Short Notice Period as per Terms. But My Department HOD, HR Head is not ready to relieve me after One Month and asking me to serve three months notice period by physical presence and if i am not doing that then they told that you will be facing dire consequences afterwards. Like this they are doing to each and every employee who is resigning from the Company just sticking to policy of company. I discussed it with them and tried to get them convinced but they are not ready to hear anything. They are telling me that they will destroy my career in future by giving negative reviews for me against background verification, They have even sent previous employees legal notices demanding them money for damages as well as sending notices to their current employers making false claims & creating a bad image of employee after which they were even fired from their current organization leaving them no chances except begging. As Company terms states as follows in Appointment Letter, "After your confirmation as a permanent employee, your services may be terminated by either party giving the other three months’ notice in writing or payment of salary (Gross Cash) in lieu thereof. Be noted that out of three months’ notice period, leaving employee has to serve two month notice with physical presence mandatorily. Leave application will not be entertained during the period to ensure smooth handover of current assignment. In case you effect such termination by resignation, you are required to serve complete two months physical presence before you can be relieved from the services of the Company. The Company may immediately terminate your services without any compensation or notice thereof if you are in breach of the Yanfeng Ethics Policy, Breach of confidentiality; Gross Negligence and Misconduct." One side they are trying to get balanced using "PILON Clause" and another side they are restricting freedom of Employee by writing "Physical Presence Clause" Mandatory. This is total restriction of Fundamental Rights of Citizen under Article 19 " Right to Profession" & Article 21 " Right to Life and Liberty" Sir need your help and support on the Matter.
